Terms of service

These Terms of Service regulate the rights and obligations in connection with the use of the Valuator platform located at the internet address valuator.rs.

The platform represents an information society service provided by VALUATOR LTD, Veljka Dugosevica 54, Belgrade, Republic of Serbia, registration number: 21729540, VAT: 112737776 (hereinafter: Valuator).

These Terms of Service are an integral part and represent the provisions of the contract concluded between Valuator and each platform user. Valuator enables the use of the platform exclusively in the manner and under the conditions described in these Terms of Service. By accessing and using the platform, users agree to the Terms of Service, thus concluding a contract upon accessing Valuator as the provider of the information society service.

Valuator is committed to preserving and applying the rights of personal data protection enjoyed by individuals, as well as copyright, in accordance with the rules of the information industry, good business practices, and in compliance with the laws of the Republic of Serbia.

INTEGRITY AND PLATFORM DESCRIPTION

The platform enables registered business entities to easily, transparently, and efficiently manage procurement procedures.

Any use of the platform in its entirety or any part of it that is not in accordance with the Terms of Service will be considered an abuse of the services provided by Valuator and a violation of the Terms of Service.

COPYRIGHT

Valuator has exclusive copyright and intellectual property rights to the platform, as well as to all individual elements that make it up, such as: text, visual and audio elements, visual identity, data and databases, program code, and other elements, whose author.

Unauthorized use of any part of the platform, or the platform as a whole, without express prior written permission issued by Valuator as the holder of the exclusive copyright, will be considered a violation of copyright.

USERS

Users of the services provided by Valuator through its platform are considered both visitors and registered users.

A visitor is a person who accesses the platform via the internet, in accordance with these Terms of Service, without registering or signing in. Visitors can familiarize themselves with all the content available on the platform without paying any fee.

A registered user is a legal or natural person who has registered on the platform under the conditions and in accordance with the manner set out in these Terms of Service.

A registered user has access to their own account on the platform. The user independently chooses a password during registration and is solely responsible for the confidentiality of the password and the use of the platform through their login credentials. The user will not use someone else's login credentials or give their own user data to a third party. The user can notify Valuator if they suspect unauthorized use of their login credentials.

A registered user can revoke their status as a registered user by deactivating their account from their profile on the platform. A registered user can request the deletion of their user account and accompanying data by submitting a deletion request.

Deactivating an account prevents the use of user data on the platform, with the possibility of reactivating the same, while deleting a user account permanently removes the user data from the platform.

REGISTERED USERS

A registered user can be an entrepreneur or a company registered in Business Registers Agency.

During registration, the user is required to fill out a form containing certain personal information. This information is used in accordance with the Law on Personal Data Protection and in accordance with our privacy policy.

PAYMENT OF SERVICE FEES

Registered users pay a fee for using the platform's services according to the price list in effect at the time of purchasing the service. Currently, the Basic package is active with the following price list:

• 1-month subscription - 59 EUR (6,962 RSD)
• 3-month subscription - 169 EUR (19,942 RSD)
• 6-month subscription - 329 EUR (38,822 RSD)
• 1-year subscription - 619 EUR (73,042 RSD)

When calculating the fee in dinars, Valuator DOO uses its commercial exchange rate of 118.00 dinars for 1 EUR. The commercial exchange rate is subject to change in accordance with the movement of the EUR exchange rate set by the National Bank of Serbia. This price list applies to all available functional packages.

NOTICE

The user is notified that Valuator may periodically send notifications relating to the content of the platform, notifications regarding the functioning of the platform, Valuator news, and other notifications of this type.

LIMITATION OF LIABILITY

The user explicitly accepts that Valuator is in no way responsible for the behavior of other users or third parties and that the risk of possible damage is entirely borne by those parties, in accordance with the applicable laws of the Republic of Serbia.

The user is solely responsible for the accuracy and correctness of the data entered.

This limitation of liability applies to all damage (material and/or non-material) or injuries that may arise from hidden deficiencies, errors, interruptions, deletions, defects, delays in operation or transmission of computer viruses, interruptions in communications, theft, destruction, or unauthorized access to data, changes or misuse of data by third parties, termination of the contract, behavior contrary to the Terms of Service, neglect and others.

Except in case of intent or gross negligence, Valuator is not responsible for any temporary unavailability of the platform or partial or complete malfunction or incorrect functioning thereof. Valuator is not responsible for technical problems that may lead to delays and/or incorrect processing of electronic data. Internet service providers are responsible for the above.

JURISDICTION AND DISPUTE RESOLUTION

All that is not regulated by these Terms of Service shall be governed by the applicable laws of the Republic of Serbia.

All disputes that may arise between Valuator and the user in connection with the use of the platform shall be governed by the applicable laws of the Republic of Serbia. Valuator and the user undertake to try to resolve the dispute peacefully, and if they fail, the competent court for dispute resolution is the Commercial Court in Belgrade.

FINAL REGULATIONS

Valuator has the right to change or supplement these Terms of Service at any time by publishing the changes and supplements in a cleaned-up text on the platform and sending an email to all registered users, at least eight days before the day they come into effect.

If a registered user gives an explicit response (by clicking on the link to accept the Terms of Service), it will be considered that he agrees to the new Terms of Service. If a registered user explicitly (by clicking on the link to reject the Terms of Service) does not accept these Terms of Service, it will be considered that his user status has ceased, he will be prohibited from using the account, and the contract will be terminated under the previous Terms of Service.

These Terms of Service begin to apply eight days from the day of their publication on the platform.

Each printed copy of these terms produces full legal effect under the provisions of the Law on Electronic Documents and cannot be denied validity or evidentiary power.
